Terms of Service

1. Agreement to Terms

By accessing or using TradesHelper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Service. TradesHelper is operated as a software-as-a-service application designed for trade professionals.

2. Registration & Account Security

To use the Service, you must create a profile using a valid email address and verify access via single-use security codes sent to your inbox. You are responsible for maintaining control of your email access and for all activities conducted under your account.

3. Subscriptions, Reverse Trial & Price Guarantee

TradesHelper operates on a transparent, trade-friendly subscription model:

• 30-Day Pro Trial: Every new trade account receives 30 days of full Pro toolkit access starting from registration. No credit card or payment information is required to start your trial. You will never be charged automatically at the conclusion of your trial.
• Subscription Plans & Billing: Following your trial, you may choose our Essential Plan (£5/month) or Pro Plan (£10/month). Subscriptions are billed in advance on a recurring monthly cycle on the date of subscription.
• Price Lock Promise: Your price will not rise while you stay subscribed. If subscription prices increase in the future, your rate will remain locked at your active subscription tier.
• Failed Payments & Grace Period: If a recurring payment fails, your account enters a 30-day grace period during which you retain full access while updating your payment method. If payment is not resolved within 30 days, your account transitions to read-only status.
• Easy Online Cancellation: You can cancel your subscription at any time online via your Account settings page in one tap. We do not require telephone calls, minimum notice periods, or administrative cancellation fees. Your cancellation takes effect at the conclusion of your current paid billing period.
• Statutory Cooling-Off: If you are a consumer in the UK or EEA purchasing a paid subscription, you have the right to cancel your subscription within 14 days of your initial purchase for a full refund by contacting support.

4. Lapsed Accounts & Read-Only Safety Net

If your trial concludes without choosing a plan, or if your subscription is cancelled, your account transitions to our Read-Only Safety Net:

• You retain complete access to search, view, download PDF copies, and export all customer records, past quotes, and invoices in standard CSV/PDF formats.
• Existing quote and invoice links already shared with your customers continue to function for review and approval.
• Creating new quotes, invoices, or job sessions requires an active Essential or Pro subscription.
• 12-Month Data Retention: We preserve your records in read-only mode for 12 months from the date of lapse. Prior to any data cleanup, we provide multiple advance email warnings (at 65 days, 14 days, and 3 days before archiving).

5. Financial & Compliance Calculations

TradesHelper provides estimate templates, tax computations (including VAT), and safety certificate generators for your convenience. You retain sole responsibility for reviewing and verifying the accuracy and legal compliance of all quotes, invoices, and certificates issued to your customers. We assume no liability for tax filing discrepancies, incorrect calculations, or local licensing non-compliance.

6. Customer Data & Communications

When you store customer details or message histories in the Service, you represent that you have obtained lawful consent from your customers to process their contact and job records under applicable privacy laws (UK GDPR and EU GDPR).

7. Limitation of Liability

To the maximum extent permitted by applicable law, TradesHelper and its operators shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, business interruption, goodwill, or data, resulting from the use or inability to use the Service.

8. Changes to Terms

We may update these terms from time to time. Material changes affecting paid subscriptions will be communicated via email or an in-app notice at least 30 days prior to taking effect. Continuing to use the Service after updates are published constitutes acceptance of the amended terms.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, without prejudice to any mandatory consumer protection rights granted to you under the laws of your country of residence (including the United Kingdom).
